Terms of Service

1. Acceptance of Terms

By creating an account or using PromptCut (the "Service"), operated by Sebastian Kwasniok ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

PromptCut is an AI-assisted video editing platform. You upload video content and provide natural-language editing instructions; we process the video using third-party AI services (Anthropic, AssemblyAI) and FFmpeg, and return a processed output file.

3. Accounts

You must provide accurate information when registering and keep your password secure. You are responsible for all activity that occurs under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

4. Acceptable Use

You agree not to upload, process, or distribute content that:

• infringes any third-party copyright, trademark, or other intellectual property right;
• contains child sexual abuse material (CSAM) or any content depicting minors in a sexual manner;
• incites violence, terrorism, or self-harm;
• contains non-consensual intimate imagery;
• violates applicable laws (privacy, defamation, hate speech, etc.);
• contains malware, viruses, or scripts intended to compromise systems.

You may not use the Service to scrape, reverse-engineer, or build a competing product. Automated access (including programmatic API hammering) outside of normal interactive use is prohibited.

5. Content and Ownership

You retain all rights to videos you upload. By uploading, you grant us a limited, non-exclusive licence to process, transcode, and store your content solely for the purpose of providing the Service to you. We do not use your content to train AI models.

Processed output files belong to you, subject to any underlying third-party rights in the source material.

6. Subscription Plans and Billing

Free, Pro, and Business plans are described on our pricing page. Paid subscriptions renew monthly until cancelled. Prices are in Euro (EUR) and shown as Endpreis. Under § 19 UStG (Kleinunternehmerregelung) we do not charge value-added tax (USt).

You can cancel at any time:

• From your account dashboard (Stripe billing portal), or
• Via the public cancellation page (§ 312k BGB Kündigungsbutton — no login required for cancellation submissions).

Cancellation takes effect at the end of the current billing period; no auto-renewal occurs after that. Pro-rated refunds for unused periods are not offered, except where mandatory law requires otherwise (in particular the Widerrufsrecht below).

Stripe processes payments. Their privacy policy and terms apply to payment data.

6a. Widerrufsbelehrung (EU consumers)

Widerrufsrecht. Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Sebastian Kwasniok, legal@promptcut.online) mittels einer eindeutigen Erklärung (z. B. ein per E-Mail versandtes Schreiben) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs. Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist.

Vorzeitiges Erlöschen des Widerrufsrechts (§ 356 Abs. 5 BGB). Bei einem Vertrag über die Bereitstellung von digitalen Inhalten, die nicht auf einem körperlichen Datenträger geliefert werden, erlischt das Widerrufsrecht, wenn wir mit der Vertragsausführung begonnen haben, nachdem Sie ausdrücklich zugestimmt haben, dass wir mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist beginnen, und Sie Ihre Kenntnis davon bestätigt haben, dass Sie durch Ihre Zustimmung mit Beginn der Ausführung des Vertrags Ihr Widerrufsrecht verlieren. Diese Bestätigungen geben Sie beim Bezahlvorgang ab.

Muster-Widerrufsformular. Wenn Sie den Vertrag widerrufen wollen, können Sie folgendes Formular per E-Mail an legal@promptcut.online senden:

7. Service Availability

We aim for high availability but make no uptime guarantees. The Service is provided "as is". Scheduled maintenance, third-party outages (Anthropic, Supabase, Stripe, Vercel) or technical issues may cause downtime.

8. Termination

We may suspend or terminate your account if you violate these Terms, abuse the Service (excessive resource use, fraud, chargebacks), or if continued operation poses legal risk to us. You may delete your account at any time via the dashboard.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is the operator's registered seat, to the extent permitted by law. EU consumers retain mandatory rights under the law of their place of residence.

11. Changes

We may update these Terms. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
